What is a Privacy Notice?

Air Charter Service is committed to complying with relevant privacy laws and regulations. This Privacy Notice describes how Air Charter Service processes the personal information we collect when you access or use our website in order to apply for an employment position. This Privacy Notice will also provide information on how we work and protect your personal information.

The Controller

Air Charter Service is the responsible party that determines the purpose and means of processing your personal information. Your personal information will only be collected for a specified, explicit and lawful purpose, and not be further processed in any manner that is incompatible with the original purpose.

Air Charter Service’s data protection and privacy measures are governed by the Privacy Act of 1974, the General Data Protection Regulation ((EU) 2016/679) (“GDPR”) and any national implementing laws, regulations and secondary legislation and other applicable national legislation, including the Protection of Personal Information Act 4, 2013 ("Data Protection Legislation") and will be amended or updated in accordance with them from time to time.

What personal information will Air Charter Service collect about me?

When creating your profile, we will collect a variety of personal information, including, but not limited to; your first and last name, email address, telephone number, current employer, current job title, your area of interest and a copy of your most up to date personal profile (cv/resume).

Additionally, we may ask for job related personal information during the selection process. This will be information about your previous work experiences and salary expectation. Furthermore you will be required to complete an ability test and a psychometric and motivational questionnaire. 

Depending on the country of interest the scope may vary. It is possible that special personal information such as trade union membership or health information are questioned. This is dependent on the local requirements of the country where the specific job vacancy is. This information will be added to your profile and processed in accordance with applicable law.

We will notify you whether the provision of such information is voluntary or mandatory, and the consequences of a failure to provide such information.

How is my personal information collected?

Air Charter Service will collect and process your personal information to fulfil requirements relating to recruitment processes.

You may directly provide your personal information to us, or we may collect your personal information from third parties, such as recruitment agencies; we may also collect information from publicly available sources such as job boards and social media platforms. To the extent necessary, you provide us with your consent to collect personal information from such other third party.

How long will Air Charter Service keep my personal information?

When you create a profile, we will retain the personal information for as long as necessary for achieving the purpose for which the information was collected or to comply with any legal or regulatory requirements, or for lawful purposes related to our functions or activities. In general, we will retain your data for a period of 24 months after your last login. You will be informed about the deletion of your profile via email. You may delete your profile at any time before the expiry of this period.

What is Air Charter Service’s basis for processing my personal information?

Air Charter Service collects and processes your personal information on the basis of different legal grounds, depending on the nature of the personal information being provided and the type of processing involved.

Performance of a Contract

Some of your personal information is processed on the basis that it is necessary to carry out actions for the performance of our agreement with you, or in order to take steps prior to entering such an agreement. An example of this would be where Air Charter Service needs to verify your identity to further the job application.

Legitimate Interest

A ground relied upon for processing your personal information is legitimate interests of Air Charter Service or of a third party to whom the information is supplied. An example would be where we respond to your queries and enquiries.

Consent

To the extent that it may be required by law (and without prejudice to our rights to process personal information in the absence of consent provided that we do so in compliance with applicable law), a ground which we may rely on in order to collect and process certain types of personal information or special personal information, or where appropriate to keep you informed of any similar job vacancies that may be of interest, is consent given by you. Compliance with a Legal Obligation

A ground relied upon for certain types of processing of personal information is that it is necessary in order for ACS to comply with a legal obligation. An example of this would be to retain business records for fixed periods of time in order to comply with local corporate legal requirements.

Who will Air Charter Service share my personal information with?

Our service providers

This includes external third-party service providers, such as accountants, auditors, experts, lawyers and other outside professional advisors; IT systems, support and hosting service providers; printing, advertising, marketing and market research and analysis service providers; document and records management providers; technical engineers; data storage and cloud providers and similar third-party vendors and outsourced service providers that assist us in carrying out business activities.

Governmental authorities and third parties involved in court action

Air Charter Service may share your personal information with governmental or other public authorities (including, but not limited to, courts, law enforcement, tax authorities and criminal investigations agencies); and third-party civil legal process participants and their accountants, auditors, lawyers and other advisors and representatives as permitted under applicable law in order to: (a) comply with applicable law, including laws outside your country of residence; (b) comply with legal process; (c) respond to requests from public and government authorities including public and government authorities outside your country of residence; (d) enforce our terms and conditions; (e) protect our operations or those of any of our group companies; (f)protect our rights, privacy, safety or property, and that of our group companies, you or others; and (g) allow us to pursue available remedies or limit our damages.

Our group companies

We are a member company of Mountfitchet Group. We may share your personal information with certain members of our group companies, some of which may be located outside of the Republic of South Africa ("South Africa") in jurisdictions which may not offer the same level of data protection as South Africa. Any such transfer outside of South Africa shall be in accordance with applicable law. Where they have access to your personal information they will use it only for the purposes set out in this Privacy Notice. Air Charter Service will remain the responsible party in relation to the management and security of jointly used personal information. Access to your personal information within Air Charter Service, and our group of companies, is restricted to those individuals who have a need to access the information for our business purposes.

Is my personal information secure?

Air Charter Service is committed to keeping your personal information safe and secure from unauthorised access to or unauthorised alterations, disclosure or destruction of information that we hold.

Our security measures include:

- Encryption of our services and data;
- Review our information collection, storage and processing practices, including physical security measures;
- Access control restrictions for personal information;
- Contractual confidentiality and processing agreements for employees and/or third parties who may require access to personal information; and

If you continue to use the website after changes have been affected to this Privacy Notice, you will be deemed to have consented to such changes.
